Use of the Dealers' Guide valuation service is conditional upon, and implies acceptance of the following:

i. Dealers' Guide (referred to as DG below) valuation data is prepared by experts on a best efforts basis, however we cannot represent or guarantee that the material is entirely accurate, complete or up-to-date. No third party should rely on the information without independent corroboration.

ii. DG does not guarantee that the services providing access to electronic information will be error free or uninterrupted.

iii. Use of the DG service is conditional upon the user indemnifying DG for any loss or liability including all legal costs or other expenses arising out of use of the DG services.

iv. The customer's exclusive remedy and DG's sole liability shall be refund of the cost of the service fee. DG will not be liable for consequential, incidental, special, exemplary or other direct or indirect damages arising out of use of the service, or from inability to use the service.

v. DG retains full and complete ownership of all material including software, databases, valuation data, vehicle data, related images and website content, regardless of format, delivery mechanism or physical location.

vi. DG grants users limited licence rights to use valuation data for the purpose intended. DG data must not be copied, modified, reverse engineered, decompiled, disassembled or converted in any way whatsoever (including creating derivative works) without DG's explicit prior consent.

vii. Where DG data is purchased for business purposes, the buyer agrees that the Consumer Guarantees Act 1993 does not apply. DG contracts out of the Act to the extent permitted by the Consumer Guarantees Act 1993.

viii. All copyright subsisting under the Copyright Act 1994 resides with DG. Apart from any fair dealing for review or research as permitted under the Act, no part of the data may be copied, reproduced or re-transmitted without DG's explicit prior approval. Where review or research occurs as permitted under the Act, a statement that the information is subject to copyright and is owned by DG must be included.

ix. Links to this website may be created, but are at the creators risk and must be to the home page (index.html) only. Any link must be text only and must not include DG logo or other propietary material without DG's explicit prior approval.

x. No link to this website may contain information that is inaccurate, unlawful, disparaging of DG or Carjam services, infringes any third party's rights, implies or states that DG has given explicit permission for the link, implies endorsement from DG for your products and services or is offensive.

xi. Anyone creating a link to this website automatically grant DG the right to view the linked site to check compliance with our conditions

xii. Any link to this website must be removed immediately on request.

xiii. DG may at its sole discretion, amend or add to these terms and conditions. Users accept that the current terms and conditions at the time of use of the service will apply, whether amended or not from those at the outset of use or at other times.
